Sussex County Man, 22, Pleads Guilty To Assault By Auto In Head-On DWI Crash That Injured Child

A Sussex County man pleaded guilty to assault by auto and DWI in connection to his role in a head-on DWI crash that injured two victims, including a young child, authorities said Tuesday.

Kyle D. Smith, 22, admitted to using marijuana when he crossed the center line and crashed head-on into another car on Route 206 near Whitehall Hill Road on Feb. 12, Byram Township Police said at the time.

The crash seriously injured the other driver and hospitalized a young child, police said.

Smith, of Newton, pleaded guilty to third-degree assault by auto and a summons for driving while under the influence during a Sussex County Virtual Courtroom appearance on June 17.

He was sentenced for the DWI charge to a seven-month loss of his driver’s license, as well as a seven-month Interlock program and payment of court fees totaling $689, Sussex County Prosecutor Francis A. Koch said.

Smith will be sentenced for the assault by auto charge before the Honorable Louis S. Sceusi, J.S.C., on July 14, Koch said.

Smith was represented by Howard Bailey, Esq., and the State was represented by Assistant Prosecutor Brent M. Rafuse.
